Court dismisses ABF’s lawsuit against YRC and Teamsters

YRC Worldwide has announced the dismissal of the ABF Freight System lawsuit. The US District Court ruled that ABF Freight System does not have standing to sue YRC Worldwide and the union in court.

YRC’s new labour contract with the Teamsters extended the previous agreement (due to expire in 2013) until end-March 2015.

But ABF said the contract violates the NFMA (the collective bargaining agreement covering most unionised trucking employees in the US), and filed a grievance under the NMFA and also an accompanying lawsuit against the Teamsters, and YRC, seeking approximately US$750 million in financial damages.

The Teamsters called ABF’s lawsuit "frivolous and without merit", and Dow Jones reported that YRC Worldwide’s chief executive Bill Zollars said that the company would likely launch a counter-suit.

"From the moment the suit was filed we were extremely confident it had no merit," said Mike Smid, YRC president and chief operations officer at YRC Worldwide. "We are gratified that after a thorough review of the facts the judge came to the same conclusion and dismissed this case."

He added that the agreement was negotiated in good faith with the union was ratified by YRC’s employees who have remained committed to the company and its customers.
