Russian Federation will exit the TIR Carnet procedure

Nationwide withdrawal of the Federal Customs Service of the Russian Federation FCS from the TIR Carnet procedure effective 1 December 2013

„The Federal Customs Service of the Russian Federation has extended the request for additional collaterals for transport under TIR Carnet to Moscow and the North-West region. From 1 December 2013 the conditions will apply nationwide,“ the Austrian association of international road transport enterpreneurs AISÖ announces in a press release.

Contrary to the decision of the Supreme Arbitration Court of the Russian Federation on 14 October 2013, which declared illegal the deposit of additional collaterals for transport under the TIR Carnet in Russia, the Federal Customs Service of the Russian Federation (FCS RF) has extended the restriction of the TIR Carnet procedure.

Since 12 November 2013, additional collaterals are required for transport under the TIR Carnet in the central region (including the Moscow region) and from 19 November 2013 also in the north west-region. The northwestern region includes the customs territory of Pskov, Sebezh and Kingisepp responsible for the borders with Latvia and Estonia; the only exception will then be the Russian border with Finland (customs district Vyborg).

The Russian customs authorities ultimately announced the nationwide exit from the TIR Cartnet procedure effective 1 December 2013. The FCS RF justified their action with the termination of their contract with the ASMAP, the national guaranteeing association of Russia, previously issuing the TIR Carnet in Russia and guarantees for the proper handling of the carnet in Russia.

„If adoption of a TIR Carnet is denied by the Russian customs authorities, TIR Carnet holders should consider the risks of these guarantees before making a decision on the possible use of additional guarantees, as they are required by the Federal Customs Service of the Russian Federation (FCS RF),“ recommends the International Road Transport Union (IRU). According to the information available, different types of guarantees are possible: guarantee, cash deposit and bank guarantee.
