ÖBB files charges against Gustav Poschalko

ÖBB make serious accusations against the former manager KommR Gustav Poschalko; the ex-manager of the railway enterprise rejects the suspicion of embezzlement

As the newspaper “profil“ reports in its issue from 30 June, the ÖBB has filed a statement of facts about inconsistencies of Express-Interfracht (EXIF), a subsidiary of Rail-Cargo to the Public Prosecutor’s Office against Corruption.

This statement contains severe accusations against Gustav Poschalko, who had been an ÖBB manager until 2008. According to the statement, together with 22 persons and companies he has caused an economic damage of EUR 93 million to his former employer ÖBB through non-traceable payments of commissions in Poland, the Ukraine and Byelorussia and unsecured credit agreements between 1997 and 2009.

A report of the HBA lawyer’s office reads: “Gustav Poschalko is suspected of having issued credit notes and having paid commissions without recognisable service in return, as well as having purchased receivables and taken over liabilities, thereby knowingly misusing his power to dispose of external assets.“ Poschalko is suspected of embezzlement and forming a criminal organisation.

The statement of facts, which is available to “profil“, continues: „The damage to EXIF through its persons in charge had been accepted knowingly, and there is a suspicion that the persons in charge at EXIF and others made money out of this action.“ The payments of EXIF to various companies in the UK, Luxemburg or the Czech Republic had no „economic justification“ and „did not produce any economically equal service in return, causing a damage of EUR 92,906,997.55 to EXIF“.

Poschalkos lawyer Rüdiger Schender comments to „profile“ that „KommR Poschalko is not aware of a statement of facts against him.“ He has no knowledge of payments to companies and could exclude those for his area. Therefore, he could give no statement at the present time; he could also exclude any personal enrichment.
