US Attorney calls for dismissal of indictment against Agility subsidiary

The US Attorney’s office has moved to dismiss the indictment against an Agility subsidiary, following the company’s filing of motions to discover the government’s evidence against it.

This evidence includes, but is not limited to, the Price Negotiation Memorandum, a set of exculpatory materials that Agility says the government has tried to conceal from the public for more than three years.

The US Dept of Justice obtained an indictment against Public Warehousing Co (PWC) in November 2009, alleging that the company defrauded the US government during the term of its contract to supply food to US troops in Kuwait and Iraq.

At the time, Agility stated that the allegations were without merit, and the company has consistently maintained that this case should never have been brought in the first place in a criminal court, since it is – at most – a civil dispute over the interpretation of a contract drafted by the government.

The food contract at issue is one of nearly 130 US government contracts and tenders by Agility and its affiliated companies.

Agility says it remains committed to attempting to resolve this civil contract dispute.

However, as pointed out by Transport Intelligence, charges are still being brought against two other Kuwait-based parts of the company, which Agility is also trying to have dismissed.
