‚Verfahren 4200‘: Karl Hannl presents German legal opinion

The steady issue of customs declaration according to the 4200 code in the European Union was now also examined by legal expert Klaus Reiche

The report on customs clearance according to the 42xx code of the Austrian transport magazine Österreichische Verkehrszeitung brought more experts onto the scene. Thus Karl Hannl, Hannl + Hofstetter Int. Spedition GmbH, who is dealing with the question of the representative, provided our editorial office with information about a counter-opinion in this case. He is aiming to free forwarders from possible subsequent liabilities related to the import sales tax, “as we can’t be liable for things we are not in charge of“, Hannl emphasises.

As we informed in our news ‚Expertise illuminates risks of 42xx customs clearance’ on www.oevz.com (11 July 2012), the Austrian Economic Chamber’s professional association of logistics and forwarders – Fachverband Spedition und Logistik in der Wirtschaftskammer Österreich (WKO) ordered a legal opinion from Deloitte on customs clearance according to the 42xx code – the so-called third party country or EU customs clearance – with the use of special UID numbers for forwarders. Karl Hannl, with the support of 16 forwarders and an insurance company, in turn ordered and recently received a counter-opinion from judge Klaus Reiche, former member of the customs senate of the financial court Finanzgericht Hamburg.
